If you’re in a genuine relationship with a same-sex settled partner, you can apply for a same-sex partner visa to join them in the UK. Whether you’re outside the UK or already here on a different visa, our experienced immigration lawyers are here to guide you every step of the way. Let us help you build your life together in the UK.
What is a UK Same-Sex Partner Visa?
The UK same-sex partner visa is for couples in long-term, committed relationships. To apply, you must have lived together for at least two years in a relationship “akin to marriage or civil partnership.” If you’re looking to settle in the UK with your same-sex partner who is a British citizen or has indefinite leave to remain, this is the correct route for you.
Who Can Apply?
You can apply for the same-sex partner visa outside the UK through your local British Embassy, Consulate or High Commission. If you’re already in the UK and have held a valid visa for over six months, you can switch to this visa from within the country.
Family visa application
Complete representation services for the family visa application. Entry clearance/leave to remain for individuals outside the European Economic Area (EEA) and Switzerland who wish to join their settled or British partners.
Requirements You Must Meet:
To qualify, applicants must satisfy several requirements under the Immigration Rules:
- Both partners must be 18 years or older.
- The relationship must be genuine and ongoing.
- You must meet the financial requirements: a minimum gross income of £29,000 or savings of £88,500.
- English language knowledge is required at CEFR level A1, unless you’re from a majority English-speaking country.
- You must pay the Immigration Health Surcharge.
- Depending on your country, you may need to pass a tuberculosis (TB) test.
- You must have adequate accommodation in the UK without claiming public funds.
Exemptions from the Financial Requirement
If your UK same-sex settled partner receives specific benefits, such as Disability Living Allowance or Carer’s Allowance, you may be exempt from the £29,000 income rule. In that case, you must prove that you and your partner can live and be accommodated without relying on public support.
Accommodation Criteria
Accommodation must not be overcrowded or violate public health regulations. You must also show that the place you intend to live meets UK housing standards.
Visa Validity and the Route to ILR
Once approved, the UK same-sex partner visa is granted for 33 months. If applying from within the UK, the visa is valid for 30 months. This visa leads to Indefinite Leave to Remain (ILR). For those who applied before 9 July 2012, ILR can be used after two years. Five years of continuous residence under this visa is required for those who applied after.
UK same-sex partner visa extension
You may extend this visa for another 30 months. However, you must prove your relationship is genuine and sustainable and continue meeting the financial requirements.
The Home Office changed the Immigration Rules. Because of this, applicants whose leave to remain as partners expires on or after 1 May 2017 will have to meet the English language requirement at level A2 of the CEFR when applying for their visa renewal.
